What constitutes an HMO ?

I would appreciate some advice regarding whether my property is a HMO ?
I own a mid-terrace property which was converted into 3 self-contained flats in approximately 1969.
flat 1 (ground floor)  is occupied by a single mother and 1 child.
flat 2 ( which is a mid-landing small studio) is occupied by 1 person.
flat 3 ( which is a 3 bedroom maisonette) which is currently unoccupied ,which I'm in the process of letting to 2 tenants.

any advice would be very appreciated.

The definition of HMO under Housing Act 2004, and not e.g. council tax:

If the conversion is not in full compliance with builiding regulations in effect as of 1st June 1992, then yes. Otherwise...

If only the two of them live there, no. If they do not form a single household, and there's another adult living there as well, then yes.

I am in the process of converting a house into 4 units. can they still be classed as an HMO if they all have their own bathroom and cooking facilities? There will be a shared laundry/utility room.
