No Gas saftey cert No Deposit scheme.

Hi there well to say the least I have a bit of a problem. one of my tenants is ending her lease she is £400 in arrears so I explained I would take it from her deposit.

The tenant then told me she wants her full deposit and month up front back(she is paid up until end on sep) and she would move out quietly.

When I asked her what she meant by quietly she then went on to say if I don't she will report me and my EX business partner who was supposed to deal with safety checks maintenance etc.

I of course investigate to show this tenant she is very much in the wrong and to my horror she is very much correct and the more I started looking this is the same case for 6 of my other property's.

so basically the tenant has me backed into a corner.

Any comments and suggestions even if its just to ask why I was so stupid lohttp://www.justice.gov.uk/about/hmcts/l

 :)your tenant may have a point.. would let her leave quietly as she
states. let her keep the 400 deposit, .you don't want tenant making waves.
it may be hard for you to do this, but my feelings are it would be easier in the
long run..i am sure there a lots of properties out there without gas safety certs.
but is the law can bring big fines for not having.. its for tenants safety.
get the other properties checked if you get same gas registered plumber to check
you may be able to get discount.. that's why I use a letting agent.. they remind you
when these thing are due.. pat testing, electrical safety, etc..

they can claim THREE TIMES the deposit back as it wasn't in the scheme, I'd (and have) give her the money and save the hassle.
