Hi Guys

Hoping someone can help by casting their eye over my s21

6 month AST commenced 1/7/2011.

s21 raised at start of tenancy by letting agent(a few weeks after tenancy commenced).

s21(1)b dated 28/7/2011 and signed by both tenants also dated 28/7/2011. States after 31/12/2011. Signed on my behalf by letting agent.

Deposit lodged with DPS on 11 July, prescribed info forms part of the AST.

The dates in the s.21 Notice seem fine. Did you also include the saving clause "...the landlord requires possession after the date stated in this notice or at the end of the period of your tenancy which will end next after the expiration of 2 months from the service upon you of this notice" ?

I note the deposit was protected on 11 July 2011 and if I have read your post correctly, the s.21 Notice was served on 28 July 2011. If so, this is fine, as the deposit had been protected before you served the s.21. I'm not sure what "s.21 raised at start of tenancy by letting agent" means? If it means the s.21 notice was served on the tenant at the start of the tenancy (i.e. before the deposit had been protected on 11 July 2011) then the s.21 will be invalid.
