Hello,  Does anyone know how we would stop any future tenants from advertising our flat on airbnb.   We recently discovered that our tenant was not living at our flat, but renting it on airbnb, which they are not supposed to do according to the AST agreement, but there is not penalties for doing so, so tenants can seem to do as they please.  Airbnb do not even check who owns the property clearly.

I assume that you served notice on them? It is not all that common,so it may never arise again.If it does,all you can do is serve notice and of course take every step to check out the references and ratings when vetting applicants.

If they're not living there, they don't have an AST, because that requires residence. They also can't be illegally evicted (in the sense that it could be treated as a crime). So you can serve a notice to quit on them and then lock them out when it expires. They might try and take legal action for breach of contract, but that's risky for them.

If you tell AirBnB they don't own the place and have no right to let it out, they should, in theory, stop them. But there's almost nothing to stop them from simply joining again.
