Hi,
I handed over the keys of my property to a letting agent.
The letting agent allowed a DSS tenant to move into the property 3 months ago without giving me details.
The letting agent signed a contract with the TENANT for 6 months and he is taking COMMISSION to fully manage my property from the rent.
He DID NOT sign a contract with me (landlord) and when I ask him to sign a contract with me he is hesitant to do it.

Recently, I found out that the TENANT did not pay any deposit and landlord did not collect it.

The tenant has made a lot of changes in the property without my written consent as per the tenant's contract with the letting agent.
Some of those changes damaged my property as well and I have to fix all those damages before I find a new tenant.
Who is liable to fix the damages caused by the tenant - tenant / letting agent / landlord?
If it is the tenant and if the tenant does not do it, there is no deposit collected from the tenant by the letting agency, is it not the letting agent's fault?
All these problems happened due to the mismanagement of the letting agent - No deposit collected from the tenant, no contract signed with me (landlord) and did not ask my written consent before altering my property.
Thanks,

boboff

You, you you, you. It's up to you to sort it!

You need to speak to the Agent.....

There may be a council bond in place for repairs, which would be handy.

Your agreement is with the Agent not the tenant, provided that is what is in the agreement with the Agent.

You gave your keys to an Agent, I assume after signing an agreement.

There are a number of buy to let mortgages which exclude any DSS tenant ( Coventry for example) and if the agent has done this he is a naughty boy!

Your use of bold text is impressive, and on that basis I am sure you'll have no problem sorting out your problem.

Can an Agent sign an AST with a Tenant for a property they don't own? I would hope not. Unless given specific permission to do so by the Landlord, the owner of the property. If no deposit was taken, then at least you aren't going to be liable for non-protection of the deposit. If a deposit had been taken and the Agent didn't protect it properly on your behalf, or you didn't (and, at the end of the day it is your responsibility to do so) then you could be in an even worse position, potentially you could be sued for 1x to 3x the deposit amount. As is said before, you yourself must have signed something with the Agent, likely giving them leave to do [some] of the things they've done?

Is it not clear whether you asked the Agent to sign a contract with you or the Tenant... "He DID NOT sign a contract with me (landlord) and when I ask him to sign a contract with me he is hesitant to do it."

All that said, Agents, ey?

Hi,
I want to sign a contract; but the agent is hesitant to hand over their terms and conditions and sign it.
How can I get the landlord to sign a contract with me?
They are taking their commission.
Is there any legal support for me?
Thanks
