Hi

After some advice please

I had a tenant who wanted to exit the tenancy agreement early, I agreed to this provided I found another tenant.

We agreed an exit date and they paid rent upto this point, I have refunded their deposit.

The old tenant has handed their keys back earlier than the agreed date through their choice

Can I let the property to the new tenant early and do I have to refund the rent the old tenant paid

Given that it was their choice to hand the keys in I'm not sure where I stand

As they have handed their keys back you can let the new people move in.You are not obliged to refund the rent.Have they tried to demand this?

How much earlier than the agreed date did they hand their keys back?

Yes, you may let the property early because there is no doubt that the old tenant has permanently departed. But are you actually able to? Would the new tenant want to move in early?

Even if they do start early there is still a void period, and you are going to be out of pocket compared to what was initially agreed, when you (presumably) had the new tenant lined up to move in straight away.

No, you don't have to refund the rent if you don't wish to.

How good was the old tenant? If they have been particularly helpful, then you may wish to refund some or all of it out of the goodness of your heart.
