Hi everyone, so if you have a no break clause contract with a tenant who isn't paying rent how many Section 8s can you send?
So if you send one and they pay a little and dont pay the next month and then you send them another and repeat a few times will a judge eventually realise that these tenants aren't serious and order them to leave?
Because then every tenant can do that and get away with not paying the full rent!

Thank you in advance.

You can give as many and as often as you want so long as it doesn't cross the line over into harassment.

A particular notice is valid for 12 months, so you really have no actual need to give more often than that unless you're serving under new grounds.

If by "pay a little" you were thinking of ground 8 for example, the ground is met if "both at the date of the service of the notice under section 8 of this Act relating to the proceedings for possession and at the date of the hearing", so it doesn't matter if the amount of arrears falls under the theshold after you serve notice, but it goes back above by the date of the hearing.

For ground 11, it'll serve you better if you simply send a rent demand with an accurate and updated schedule of rent paid and due every period rather than a new notice.
