Hello  We have just agreed with the management company who let one of our properties to terminate our contract with them but do we need a new tenancy agreement with the tenant?  The TA will still be between ourselves and the tenant but there will be a different account for them to pay the rent into, they have already been advised to contact us direct if they have any issues with the property due to issues with the management agency who were not reporting issues to us.

Thanks in advance

The existing tenancy agreement continues.

You need to send the tenants a Section 3 and a Section 48 notice:

Section 3
Notice to Tenant of Assignment of Landlord's Interest

1. To: [Names of tenants]
[Address of property]

2. In accordance with Section 3 of the Landlord and Tenant Act 1987, take notice that the
interest of the Landlord in the premises [Address of property] of which
you are tenant, has been assigned to [Landlord name], whose
address at which notices (including Notices in Proceedings) may be served on the landlord
by the tenant is:
[Landlord address]
[Optional email address]
[Date]
[Signature]

QuoteLandlord and Tenant Act 1987
Section 48

and address at which notices (including Notices in Proceedings) may be served on the
Landlord by the Tenant are:

Send them the revised bank details for rent payment:

Quote
1. To: [Names of tenants]
[Address of property]

2.In accordance with your Tenancy Agreement, your 'Rent Due Date' is the XXth of each
calendar month.

3. Please pay your rent of £XXX.XX to the following account from XXth April 2023 onwards:
Account type: Personal
Account holder's name: XXXXXXXX
Sort code: XX-XX-XX
Account number: XXXXXXXXXX

When I did this I also sent:

1. A copy of the existing tenancy agreement
2. The original inventory report
3. Gov.uk How to Rent booklet
4. Copy of Gas Safety Record
5. Copy of EICR
6. Copy of EPC
7. Revised deposit protection details: Deposit Protection Certificate / Prescribed Information / Deposit Scheme Advisory Leaflet

Not all of the above are required by law but I wanted to make sure that I had a record of sending the tenants everything.

Get the tenants to confirm that they have received all of the above (send them a letter to sign and return)
